Terms of Service

These Terms govern your use of the Back in Stock application (the "App") installed from the Shopify App Store. By installing and using the App, you accept these Terms.

1. Publisher

2. Service Description

The App allows Shopify merchants to:

• Display a "Notify Me" button on out-of-stock product pages via a Theme App Extension
• Collect shoppers' email addresses for a given product or variant
• Automatically send email notifications when stock is replenished
• Access a dashboard listing demand per product

3. Pricing

The App is currently free with no time limit. No credit card is required at installation.

The publisher reserves the right to introduce additional paid features in the future (Pro plan, premium integrations). Features currently available will remain free for existing installs.

4. Technical Limitations

• Daily send limit: 100 emails per day per shop. Beyond this limit, notifications are postponed to the next day.
• The App depends on the Shopify Admin API and the Resend email service. The publisher is not liable for outages caused by these third-party services.
• Actual email delivery depends on the merchant configuring a valid Resend API key and an authenticated sender domain (SPF/DKIM).

5. Merchant Obligations

By using the App, the merchant agrees to:

• Comply with applicable data protection laws (GDPR, CCPA, etc.)
• Inform their customers of notification emails in accordance with their own privacy policy
• Not use the App to send spam, fraudulent, illegal, or misleading content
• Configure a sender domain they legitimately own
• Keep their Shopify shop active and up to date

6. Intellectual Property

The App, its source code, trademarks, and documentation remain the exclusive property of the publisher. No license is granted beyond the right of use for the duration of installation.

7. Service Availability

The App is provided "as is", without warranty of continuous availability. The publisher strives to maintain high uptime but cannot guarantee the absence of interruption.

8. Limitation of Liability

To the extent permitted by law, the publisher shall not be liable for:

• Lost revenue, customers, or data resulting from service interruption
• Merchant configuration errors (invalid API key, misconfigured domain)
• Misuse of the App by third parties
• Failures of third-party services (Shopify, Resend, hosting provider)

In any event, the publisher's cumulative liability is limited to the amount actually paid by the merchant for the App over the past 12 months (zero for the free plan).

9. Uninstall

The merchant may uninstall the App at any time from their Shopify admin. Per Shopify obligations, all data associated with the shop is deleted within 48 hours via the shop/redact webhook.

10. Personal Data

The processing of personal data is described in the Privacy Policy.

11. Changes

The publisher may amend these Terms. Material changes will be notified in the App's admin dashboard at least 30 days before taking effect.

12. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute falls under the jurisdiction of the competent court at the publisher's domicile, unless a mandatory legal provision provides otherwise.
